This Privacy Policy explains how Ginni AI, Inc., a Delaware corporation doing business as Tuner ("Tuner", "we", "us", or "our"), collects, uses, processes, and shares personal data when providing our analytics and observability platform for voice-based AI systems and agents, including our website, APIs, and SDKs (the "Services"). It also outlines your rights and choices with respect to that data.
Scope of this Policy
This Privacy Policy applies to the following categories of data:
Customer Data: Data that our customers submit to or make available through the Services, including data processed on their behalf. For Customer Data, Tuner acts as a data processor and processes it only to provide the Services and in accordance with our customers' instructions.
User Data: Information related to authorized users of our Services, such as employees, contractors, or developers acting on behalf of a customer.
Prospect Data: Information related to individuals who interact with our website, marketing materials, or communications prior to becoming customers.
For User Data and Prospect Data, Tuner acts as the data controller.
"Personal Data" means any information that identifies or can reasonably be used to identify an individual, either alone or in combination with other information.

Data Collection & Processing
What Data Do We Collect?
Depending on how the Services are configured and used, we may collect and process the following categories of data:
Account and User Information: Name, email address, role, organization details, and other information necessary to create and manage user accounts.
Configuration Data: Information related to agent configurations, monitoring rules, evaluation criteria, integrations, and system settings.
Usage and Telemetry Data: Logs, metrics, performance data, interaction events, and other diagnostic data generated through use of the Services.
Voice-Related Data: Depending on configuration and integrations, voice interactions or data derived from them, such as call recordings, transcripts, metadata, and analytics outputs.
Simulation Data: Scenarios, scripts, and inputs that customers provide when running simulated calls, along with the resulting recordings, transcripts, and results.
Technical Data: IP address, device identifiers, browser type, operating system, and similar technical information.
Communications Data: Information contained in communications with us, including support requests and feedback.
Third-Party Integration Data: Data received from third-party services that customers choose to connect to the Services, in accordance with those integrations.
Tuner's use and transfer of information received from Google APIs will comply with the Google API Services User Data Policy, including the Limited Use requirements.
Simulation Data
Simulation features are intended for synthetic or test data. The PII redaction and configurable retention controls available for production call logs do not apply to simulations. We ask customers not to use real personal data in simulations. Customers who do so are responsible for that data.
Use of AI and Model Training
We do not use Customer Data to train or fine-tune AI models without your explicit permission. Where we use third-party AI providers to deliver features such as evaluations and call analysis, we use them under terms that do not permit them to train their models on Customer Data.
Legal Basis for Processing
Where required under applicable data protection laws, our legal bases for processing personal data include:
Contractual Necessity: Processing necessary to provide the Services under our agreements with customers.
Legitimate Interests: Processing required to operate, secure, and improve the Services.
Consent: Where applicable, consent provided by users or customers. You may withdraw consent at any time.

Consent and Authorization
Customers are responsible for ensuring they have all rights, permissions, and consents needed to provide data to Tuner. This includes any notices and consents required under call recording and monitoring laws before voice data is sent to the Services.
Users may revoke authorizations or disconnect integrations at any time, subject to the continued operation of the Services.

All service providers are contractually required to protect personal data and process it in accordance with applicable data protection laws.
Aggregated and De-identified Data
We may create aggregated or de-identified data from the data we process and use it to operate, analyze, and improve the Services. We will not use or share such data in a way that could identify an individual.
International Data Transfers
We are based in the United States, and personal data may be processed or stored outside your country of residence. Where required, we use appropriate safeguards, such as Standard Contractual Clauses and the UK Addendum, to protect personal data transferred internationally.
Data Retention
Customer Data, including call recordings and transcripts, is retained according to the customer's plan and settings:
Pay-as-you-go plans: data is retained for 30 days and then deleted.
Other paid plans: customers can configure or extend retention.
Enterprise plans: retention is set by agreement.
On eligible plans, customers can delete raw call recordings and transcripts while keeping derived analysis data, such as metrics and evaluation results.
We retain User Data and Prospect Data for as long as necessary to provide the Services, meet legal, accounting, or regulatory requirements, resolve disputes, and enforce our agreements. To request deletion of your account or data, contact privacy@usetuner.ai.
Data Security
We implement appropriate technical and organizational measures to protect personal data against unauthorized access, disclosure, alteration, or destruction. These measures include encryption, access controls, and regular security reviews.
No system is completely secure, and we cannot guarantee absolute security of data.
Marketing Communications (Email & SMS)
If you provide your email address and/or phone number and opt in to receive communications from Tuner, we may send you periodic email and/or SMS messages, such as updates, new briefings, and promotional communications.
We may collect and store your contact details (email/phone number), your communication preferences (if provided), and records of your opt-in and opt-out (such as timestamps) to operate these communications and honor your choices. We do not share your contact details with third parties for their own marketing purposes without your explicit consent. Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the Text Message services.
Opting out: You can unsubscribe from emails using the link in any marketing email. For SMS, you can opt out at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. Carrier charges may apply.
Your Rights
Depending on your jurisdiction, you may have rights to:

Tuner does not engage in automated decision-making that produces legal or similarly significant effects on individuals. Outputs generated by the Services are analytical and informational in nature. Customers retain full responsibility for how insights and analytics are interpreted and used.
Children's Privacy
The Services are designed for businesses and are not directed to anyone under 18. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, contact us and we will delete it.
Third-Party Websites and Services
The Services may contain links to third-party websites or services. We are not responsible for the privacy practices or content of those third parties, and we encourage you to review their policies.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of the Services after changes become effective constitutes acceptance of the updated policy.
