These Terms of Service (“Terms”) govern your access to and use of the services provided by Tuner (“Tuner”, “we”, “us”, or “our”), including our website located at usetuner.ai and any related software, APIs, and services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.
Eligibility and Use
The Services are intended for use in a business or professional context. By using the Services, you represent that you are at least 18 years old and that you are using the Services for internal business or professional purposes.

Description of the Services
Tuner provides an analytics and observability platform designed to help customers monitor, analyze, and understand the behavior and performance of voice-based AI systems and agents.
The Services provide analytical, diagnostic, and informational outputs only. Tuner does not operate, control, or make decisions on behalf of customer systems or agents, and does not guarantee the accuracy, completeness, or reliability of any outputs.
Accounts and Access
To access certain features of the Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information and to keep your account information up to date. You must promptly notify us of any unauthorized use of your account.
Acceptable Use
You agree not to:
Use the Services for any unlawful, harmful, or fraudulent purpose
Interfere with or disrupt the integrity or performance of the Services
Attempt to gain unauthorized access to the Services or related systems
Use automated means to access the Services in a manner that exceeds reasonable usage or violates these Terms
Reverse engineer, decompile, or attempt to extract source code from the Services, except to the extent permitted by law

You represent that you have all necessary rights, permissions, and consents to provide Customer Data to Tuner for processing in connection with the Services.

The Services, including all software, documentation, and related materials, are owned by Tuner or its licensors and are protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services solely for your internal business purposes.
You may not copy, modify, distribute, sell, lease, or create derivative works of the Services except as expressly permitted by these Terms.
Third-Party Services and Integrations
The Services may integrate with or link to third-party services, platforms, or tools. Tuner does not control and is not responsible for the content, availability, or practices of third-party services.
Your use of third-party services is governed by their respective terms and policies, and you are solely responsible for complying with them.
Fees and Payment
Certain features of the Services may be subject to fees. Pricing, billing terms, and payment requirements will be communicated to you separately and may change from time to time.
Unless otherwise stated, fees are non-refundable except as required by law.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TUNER DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY OUTPUTS OR INSIGHTS WILL BE ACCURATE OR COMPLETE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
TUNER’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TUNER FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify and hold harmless Tuner, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to:

Your Customer Data
Your violation of these Terms or applicable laws
Suspension and Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services.
Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination will remain in effect.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
You agree to submit to the exclusive jurisdiction of the courts located in California for any disputes arising out of or relating to these Terms or the Services.
Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on our website with a revised “Last Updated” date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
